Welcome to Heather! These Terms of Service ("Terms") govern your use of the Heather mobile application ("App") and website ("Website"), operated by Orion Tech Solutions LLC ("we," "us," or "our").
By accessing or using Heather, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use Heather.

By using Heather, you represent and warrant that you meet all eligibility requirements.
You can use Heather in guest mode without creating an account. If you create an account, you agree to provide accurate information and keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access to your account.
Guest mode stores your preferences locally on your device. This data may be lost if you uninstall the app or clear app data. Creating an account syncs your data to our servers.
Heather provides outfit suggestions based on weather data and your personal preferences. These suggestions are recommendations only. You are responsible for your own clothing choices.
Weather data is provided by Open-Meteo and is subject to their accuracy. We do not guarantee the accuracy of weather forecasts or outfit suggestions based on that data.
The wardrobe feature allows you to catalog your clothing items. This data is stored securely and used only to provide personalized suggestions.
Free accounts are limited to 50 wardrobe items.

You retain ownership of content you add to Heather (wardrobe items, preferences). By using Heather, you grant us a license to use this content solely for the purpose of providing the service to you.
If you provide feedback or suggestions about Heather, we may use this feedback without any obligation to you.
Heather and its original content, features, and functionality are owned by Orion Tech Solutions LLC and are protected by international copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our services without our written permission.
Heather uses third-party services including:
Your use of these services is subject to their respective terms and privacy policies.
You may delete your account at any time through the app settings. Upon deletion, your profile and personal information will be removed within 30 days.
We may suspend or terminate your account at any time, without prior notice, if we believe you have violated these Terms or for any other reason at our sole discretion.
HEATHER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
WE DO NOT WARRANT THE ACCURACY OF WEATHER DATA OR OUTFIT SUGGESTIONS. YOU ARE RESPONSIBLE FOR YOUR OWN CLOTHING CHOICES AND SHOULD USE YOUR OWN JUDGMENT.
HEATHER IS NOT RESPONSIBLE FOR ANY HARM THAT MAY RESULT FROM FOLLOWING OUTFIT SUGGESTIONS, INCLUDING BUT NOT LIMITED TO DISCOMFORT FROM WEATHER CONDITIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORION TECH SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF HEATHER.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100.
You agree to indemnify and hold harmless Orion Tech Solutions LLC from any claims, damages, losses, or expenses arising from your use of Heather or your violation of these Terms.
We may modify these Terms at any time. We will notify you of significant changes by posting a notice in the app or on our website. Your continued use of Heather after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
